Martin's Chase Manta Rays

• 1.No one under the age of 14 permitted in the pool area without parent/guardian.
• 2.Parents/guardians are fully responsible for all persons under age of 14 using pool facilities.
• 3.No pool parties are allowed.
• 4.No more than 5 guest allowed per household.
• 5.No glass containers are allowed in the pool area.
• 6.All conduct that endangers safety and comfort of others (running, diving, etc.) will be prohibited.
• 7.No person showing evidence of communicable disease, bodily discharges, blisters, cuts or bandages allowed entry.
• 8.No person experiencing diarrhea or gastrointestinal (stomach) symptoms allowed entry to pool area.
• 9.Persons suspected of being under the influence of drugs or alcohol shall be prohibited from entering.
• 10.No animals allowed in the pool area or dressing rooms, except service animals.
• 11.No swimming allowed during inclement weather conditions.
• 12.Adults are required to accompany children in the kiddie pool area at all times.
• 13.No one over 42’ allowed in the kiddie pool.
• 14.Kiddie pool surface may be rough, pool shoes recommended.
• 15.All children in diapers must wear plastic pants with snug fitting elastic waist and leg fitting before entering the pool. Parents must report any “accidents” to lifeguard immediately.
• 16.All persons must shower before entering the pool or kiddie pool.

Lifeguards and staff reserve the right to order residents to leave the facility if they violate rules or behave in any inappropriate manner.

RELEASE, INDEMNIFICATION AND ASSUMPTION OF RISK AGREEMENT

I hereby authorize the registrant(s) my child(ren), or for whom I serve as guardian, (which child is hereinafter referred to as “my child”) to participate as a member of the Martin’s Chase Manta Rays Swim Team (the “Swim Team”).

I hereby release the Martin’s Chase Homeowner’s Association (the “Association”), and its officers, directors, committee members, management agent, other agents and employees (collectively “Released Parties”) from all claims for bodily injury, death or property damage arising out of the participation of my child in the Martin’s Chase Manta Rays Swim Team program. I assume full responsibility for all liability in connection with such claims, and for having insurance for my child.

I agree to indemnify the Released Parties and hold the Released Parties harmless from any such claims and related costs, including claims by any minor which may be brought after attaining majority.

I hereby certify that I and my child have carefully reviewed the rules for use of the Association swimming pool and participation in the Swim Team including the risks and requirements of such a program, and that my child is sufficiently physically fit and otherwise able to safely be participant in the Swim Team activities, and that neither I nor my child have been otherwise informed by a qualified health care professional.

I understand and agree that it is my responsibility to determine the appropriateness of my child’s participation in Swim Team activities, and that it is not the responsibility of the Association or of any of the Released Parties.

I understand that the Association employs no health care professionals, and that its staff cannot and does not diagnose health problems.
